Nourse’s Support of Judicial Activism is Even More Bold Than That of Goodwin Liu. Nourse advocates the same principles as Goodwin Liu and does so even more aggressively.  Nourse presents her personal concept of a "self-transcending constitution" through the less-common label "New Legal Realism" rather than the widely known idea of judicial activism.  Nonetheless, she supports the same radical ideas as Liu, and her terminology should not be allowed to confuse that her self-proclaimed "radical theory of judging" seeks to circumvent our governments' guiding document (The Constitution) and allow the Judiciary to claim for themselves powers expressly reserved to our elected representatives in Congress. Click here to read the full JAG 'one-pager' on Victoria Nourse's judicial philosophy.

Confirmation of Victoria Nourse Is Legitimately Blocked by Senator Ron Johnson.   Some Nourse supporters have leveled a litany of unfounded charges against Senator Johnson for seeking to stop her nomination.  However, given Nourse's record, Senator Johnson is due to be applauded and thanked for his principled decision to withhold approval of Nourse's confirmation. Ed Whelan has given an excellent defense of Senator Johnson's proper use of Senate traditions to oppose a disconcerting judicial nominee.
