Carney’s Record Has Not Prepared Her to be an Objective Jurist


 
 

 

Carney Disregards the Use of the Constitution in Deciding Cases.  The role of a judge as articulated in Article III of the Constitution is to decide cases according to the statutes and constitutional provisions then in effect.  Toward that end it is sometimes necessary to consider how other courts have applied such statutes and constitutions.  This truth is entirely lost on Carney.  She errantly explains that: “A judge’s role is to interpret and apply the law.  A court of appeals judge must do so by applying the appropriate standard of review in his or her consideration of decisions that have been appealed, and by closely adhering to Supreme Court precedent and the prior decisions of the relevant Circuit, looking to other Courts of Appeals when useful.”[1]  Carney’s explanation of the role of a judge is entirely dependent on the opinions of other judges, and entirely independent of interpretation of legislation.

Carney Was Director of a Pro-Abortion Political Action Committee.  From 1998 to 2008 Carney worked as Director of “Women Organizing Women PAC,” a pro-abortion organization that funds campaigns of pro-abortion candidates.[2]  In short, Carney spent ten years of her legal career as director of a political group whose sole purpose was to apply a pro-abortion litmus test before supporting political candidates.  This extreme and long-term political activism creates an overwhelming appearance of bias on issues of social concern that would come before her court.

Carney Was Director of a Pro Gay Marriage Political Group.  Carney worked as Director of “Fine by Me” a pro-gay organization that is now a special project of the Atticus Circle[3] which supports gay marriage and the sanction of gays in the military.[4]  With the issue of gay marriage being debated in so many states and with the recent repeal of the so-called “DADT” it is likely that Carney would be called upon to hear cases involving the definition of marriage and issues impacting “gay policy.”  Carney’s extreme and long-term political activism creates an overwhelming appearance of bias on issues of social concern that would come before her court.

 

Carney Has a Substantial History of Financial Support for Pro-Abortion Organizations  Carney has supported: (1) Planned Parenthood, (2) NARAL Pro-Choice America, which is against all parental notification laws[5] and for federal funding of abortions,[6] (3) National Organization of Women, a pro-abortion organization, (4) Center for Reproductive Rights,[7] and (5) The National Woman’s Law Center an organization that is fighting against barriers to abortions such as individual pharmacist and doctors who are morally opposed to abortion refusing to provide abortion services.[8]  Her history of financial support for numerous pro-abortion organization, coupled with her long-term role as director of a pro-abortion political groups creates an overwhelming appearance of bias on issues of social concern that would come before her court.
